Justin Timberlake’s DWI drama in the Hamptons has taken a curious twist as his legal team have claimed police allowed his friend – who had also been ‘clearly’ drinking to drive his car home after the arrest.
Timberlake, 43, was arrested on June 18 around 12:30 a.m. when a Sag Harbor Village Police officer stopped him in New York’s Hamptons.
He was driving a 2025 BMW X7 and allegedly ran a stop sign and veered out of his lane, according to court documents.
The star told the officer he had one martini and was following some friends home, – he was later charged with a driving-while-intoxicated misdemeanor.
Timberlake’s lawyer, Edward Burke Jr., will argue that officers allowed a clearly intoxicated person to drive away while arresting Timberlake, whom he claims was not intoxicated.
Sources told TMZ the car Timberlake was following when he was arrested, came back to where he was pulled over.
A woman and her husband were in the car – with the woman asking one of the cops: ‘Are you going to arrest Justin Timberlake?’
She then allegedly offered to drive Timberlake to their house where he was spending the night – but Timberlake was arrested,
The sources added the woman asked police if she could take the singer’s rental car to her house – to which police agreed and she then drove the car away.
It was claimed the unknown woman had arrived at The American Hotel – where Timberlake had his famed martini – two hours before he did and was drinking.
It was said to have been ‘apparent’ the woman had been drinking,
Burke, Jr. – who is trying to get the case dismissed – will reportedly argue the police were ‘so off’ in their judgment and let a person who had ‘clearly been drinking drive away, right in front of their eyes.’
‘If they were unable to properly evaluate her, how could they properly evaluate him?’
Burke will reportedly make this argument to the judge as part of a motion to get the case dismissed. Timberlake is expected to appear virtually on Friday, August 2, for arraignment is on one count of DWI.
Timberlake was slammed online after his lawyer claimed the star was ‘not intoxicated’ on the night of his DWI arrest in a court hearing on Friday.

Fans quickly took to social media to lambast the star’s defense, with one writing: ‘Wink wink right ????? Let’s prove one more time to the world “if you have enough money and influence I get to embarrass a cop and get away with anything” way too loser.’
Another typed: ‘If he wasn’t intoxicated why did he refuse breathalyzer testing? If I were not intoxicated and had one drink I would have no issue taking one. ‘
Another wrote: ‘JUSTICE FOR JUSTIN’ while another claimed the star was ‘hammered’.
Another typed: ‘In another words, it’s the cops fault how there can be working that night and stop a car ran a stop sign and he knew who Justin Timberlake was and he targeted him. Is that what he’s saying????? Shame on Justin Timberlake.’
Burke reportedly made comment in the courtroom that prosecutors allegedly failed to ‘get a superior officer’s signature on the initial charging papers — and therefore the case should be dropped’.
He said: ‘The police made a number of very significant errors in this case.
‘In court today, you heard the district attorney try to fix one of those errors. But that’s just one and there are many others. Sometimes the police make mistakes and this is just one of those instances.’
Timberlake was not present in court on Friday nor did he appear virtually as he is on his Forget Tomorrow World Tour in Poland.

Timberlake’s allegedly intoxicated condition was detailed in court papers, which read: ‘His eyes were bloodshot and glassy, a strong odor of an alcoholic beverage was emanating from his breath, he was unable to divide attention, he had slowed speech, he was unsteady afoot and he performed poorly on all standardized field sobriety tests.
This is going to ruin the tour,’ the star is said to have muttered.
The New York officer – who was too young to recognize Timberlake – asked, ‘What tour?’ only to be told: ‘The world tour.’
After being arrested and taken to a police station in nearby East Hampton, he refused a breath test, said the court papers, which listed his occupation as ‘professional’ and said he’s ‘self-employed.’
The 10-time Grammy winner was released without bond later in the morning after being arraigned in Sag Harbor.
He rose to fame in the behemoth boy band NSYNC, embarked on a solo recording career in 2002 and was one of pop´s most influential figures in the early 2000s.
Jessica Biel and Justin have been married since 2012 and have sons Silas, nine, and Phineas, three, together.
Justin has continued on his Forget Tomorrow World Tour despite the arrest and Jessica has continued filming The Better Sister, which she also is an executive producer of under her Iron Ocean Films label.
Jessica also was an executive producer of the 2022 Hulu biographical crime drama series Candy in which she played accused axe murderer Candy Montgomery and Justin had a recurring role in Candy as Deputy Steve Deffibaugh.
